Terms of Use

Innovations in Medical Education and Training herein referred to as IMET ("our, we, us") provides online information and services relating to and associated with Continuing Medical Education (CME) Conferences. This section describes the Terms of Use ("Terms") which governs your use of the IMET service (the "Service(s)"), site (the "Site"), and areas ("Areas" - later defined) and are collectively known as the "Network".

Acceptance of Terms of Use

By using, visiting, registering, or browsing the IMET Network you acknowledge that you agree with and accept these Terms, as well as the terms and conditions contained within our Privacy Policy.

Eligibility

These terms are legally binding and therefore should only be entered into by individuals who have the capacity to do so. It is therefore our policy that to access and use the Network you must be 18 years of age or older and have the right, authority, and capacity to enter into these Terms. If you do not agree to these Terms then you should not access the Network provided.

We make a good faith effort to prohibit the registration of non-adults and will not knowingly collect or store personal information from those under the age of 18.

Conferences

Portions of the site require that you register ("Registrant(s)").

Registration

To register for a conference, service, or product you may do by completing the registration form accessible on the portions of the Site. Before registering you must agree that information you are providing on the registration form is true, accurate, and complete and that such information will be kept true, accurate, and complete for all intensive purposes of the registration. If any of the information you provide is untrue, inaccurate, or incomplete, we have the right to suspend, withhold, or terminate your registration as well as to deny any possibility of future registrations.

Identify Theft

Upon reasonable grounds that we find that you have registered with the site as someone other than yourself, we will cooperate with any and all lawful and legal authorities that warrant an investigation as a result of the misrepresentation you imposed and shall have the exclusive right to disclose any information provided to us in connection with the fraudulent registration.

Privacy

Any information submitted on the Site is subject to our Privacy Policy. Terms and conditions of our Privacy Policy may be referenced within these Terms. The most current version of our Privacy Policy can be found on our Site.

Site Conduct

To ensure a safe online experience we ask that you fully agree and comply with Site Conduct policies herein described. Upon reasonable grounds that we find that you have violated a portion of the Site Conduct terms that are also in violation of any applicable local, state, national, or international law or any case arising out of such violations, we will when possible cooperate with any and all lawful and legal authorities that warrant an investigation as a result.

Users agree to not conjure any entity, device, or computer code that would interrupt or limit the Site; this includes the malicious attack of any computer software, hardware or telecommunications equipment associated with the Service. You also agree not to impersonate any other person by providing false or illegally obtained information while using the Site.

Users agree to not engage in unlawful practices in connection with the Site, Service, or its Registrants.

Feedback

Users of the site may have the opportunity to submit comments and feedback related to but not limited to the Site, and CME Conferences offered and or attended. It is still your sole responsibility to ensure any information submitted does not violate any of the Terms. We have the right to review, edit, delete or refuse any material submitted that does not comply with this agreement. Upon making a submission of this regard to any Areas of the Site you automatically grant us the royalty-free, perpetual, irrevocable, nonexclusive right and license to use, reproduce, modify, adapt, publish, translate, publicly perform and display and distribute the content of the submission (in whole or part) within the United States.

All users and registrants of the site are strictly prohibited from uploading, storing, posting, or transmitting through the Site any:

Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, racist, bigoted or otherwise objectionable material that may constitute criminal offense or violate any applicable local, state, national, or international law.

Content that you do not have the rights to use in such a manner on the Site. This includes but is not limited to content that compromises or infringes upon any copyright, trademark, service mark, trade secret, patent, proprietary information or content that falls under any intellectual rights.

Content that has the intent, purpose, or means by which to exploit members or the Site by way of unsolicited forms of communications.

Content that is intended to be used for direct remote loading or access.

Content that is involved in the support or instruction of illegal conduct or activities.

All users are strictly prohibited from:

Attempting to discover any proprietary or licensed source code of the Site or the software we provide for illegal use.

Attempting to gain access to areas of the site that are designated as internal, private, or for internal use only by any means. Any and all attempts will be monitored and recorded.

Attempting to collect, store, or intercept any information about visitors or Registrants of the Site in any way.

Site Content

Intellectual Property and Proprietary Rights

All content, except for material in the public domain, included on the Site, including text, graphics, logos, designs, photographs, icons, images, and digital downloads, as well as the compilation of said content on this Site, has been licensed or is the property of IMET, and its respective suppliers. They should not be reproduced or used without permission.

Limitations on Use

You may not download (other than for browser page caching), modify, copy, distribute, transmit, reproduce, duplicate, publish, display, license, create derivative works from, or offer for sale any information obtained from the Site without our written consent or the consent of the respectful author.

Links

Some links on the Site may lead to other sites that are not related to, controlled by, or affiliated with us. We have not reviewed such sites and are not responsible for any content they may contain as they are not governed by our policies; access outside sites at your own discretion.

Notification of Copyright Infringement

If you believe that your work has been used or copied in a way that constitutes copyright infringement and such infringement is occurring on this Site please provide our Copyright Agent a notice containing the following elements:

A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest that is alleged to have been infringed;

A description of the copyrighted work or works that you claim have been infringed and identification of what material in such work(s) is claimed to be infringing and which you request to be removed or access to which is to be disabled;

A description of where the material that you claim is infringing is located on the Site;

Information sufficient to permit us to contact you, such as your physical address, telephone number, and e-mail address;

A statement by you that you have a good faith belief that the use of the material identified in your notice in the manner complained of is not authorized by the copyright owner, its agent, or the law;

A statement by you that the information in your notice is accurate and under penalty of perjury that you are the copyright owner or are authorized to act on the copyright owner's behalf.

Notification from a copyright owner or from a person authorized to act on behalf of the copyright owner that fails to comply substantially with the provisions above shall not be considered as providing actual knowledge or an awareness of facts or circumstances from which infringing activity is apparent.

International Users

This Site can be accessed from countries around the world. The Site is controlled, operated, and administered within the United States of America. You expressly agree that your use of the Site is at your sole risk. The Network is provided on an "as-is", "as available" basis. We make no representations or warranties of any kind, disclaiming such with respect to the Network. These include but are not limited to, warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted service. We assume no liability or responsibility in the event of omissions or errors within the content of the Network as well as any offsite contacts and engagements of any kind. No advice or information that you obtain from the Network or its contacts shall create any warranty on our part or the information providers. We do not represent or warrant that the information accessible via our Network is accurate, complete, timely, reliable, or current.

Limitation of Liability

Both yours and our liability shall be limited to the price paid for any products, services, and events. In no event shall we or other direct representatives be liable for the other special, indirect, direct, consequential, punitive or aggravated damages of any kind; including without limitation the loss of service, use, data, profits, or any other damages. We are not responsible or liable for any threatening, defamatory, obscene, offensive or illegal content or conduct of any other party or any infringement of another’s rights, including intellectual property rights. If you are dissatisfied with the Site, Services, or Areas, your sole and exclusive remedy is to discontinue using the Network. This provision will survive the termination of use to this Site.

Indemnification

All users of our Site whether accessing, visiting, browsing, or utilizing our Services, agree to indemnify and hold us harmless from any dispute which may arise from your breach of the Terms of this agreement. IMET, any affiliates, as well as content providers are to be held harmless for any and all claims and expenses as a result of the misuse of the Network. We reserve the right, at our own expense, to assume the exclusion defense and control of any matter otherwise subject to indemnification by you, and you shall not in any event settle or dispose of any matter without our acknowledgement, and written consent.

Allocation of Risk

You agree that the Disclaimer of Warranties, Limitation of Liability, and Indemnification provisions set forth in this agreement represent an agreed upon allocation of risk and form an essential part of the basic of their bargain, without which we would not enter into this agreement or provide the Network.

Choice of Law, Jurisdiction and Venue

You agree that the laws of the State of New Jersey and the United States will apply to all matters related to these Terms, as they would to agreements made and entered into entirely in New Jersey by New Jersey residents, notwithstanding your actual place of residence. You further agree that all lawsuits arising out of these Terms shall be brought exclusively in the Federal or State courts located within the District of New Jersey, and you hereby irrevocably submit to the exclusive personal jurisdiction of such courts for such purpose. Any cause of action you may have with respect to your use of the Site must be commenced within one year after the claim of action arises.

Right to Termination

At our discretion we reserve the right to limit, restrict, or terminate use of information on the Network, without notice, for any or no reason whatsoever.

Changes to Terms of Use

At our discretion we may change these Terms some time in the future with or without notice to you. Any changes will be posted to our Site and will supersede any previous versions posted.

General

The section headings used herein are for convenience or reference only and do not form a part of these Terms, and no construction or inference shall be derived there from. Regardless of any statute or law contrary, you agree that any cause of action you may have with respect to your use of the Network must be commenced and filed within one year after the claim of action arises.
